Who we are

"Mojave Labs," "we," "us," and "our" refer to Mojave Labs, the publisher of the Services. "You" refers to the person using the Services.

Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Services. By using the Services, you represent that you meet this requirement and that you have the authority to agree to these Terms.

Your account

Some features may require an account. You are responsible for keeping your credentials secure and for everything that happens under your account. Please notify us immediately if you suspect unauthorized use.

License to use the Services

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use our apps on devices you own or control, and to use the Services for your personal or internal business use.

For apps distributed through Apple's App Store, this license is also subject to the Usage Rules in Apple's Media Services Terms and Conditions.

Things you agree not to do

• Reverse engineer, decompile, or attempt to extract the source code of the Services, except where the law expressly permits.
• Copy, modify, distribute, sell, lease, or sublicense any part of the Services.
• Use the Services to violate any law, infringe anyone's rights, or send unlawful, harmful, or harassing content.
• Interfere with or disrupt the Services, including by introducing malware or attempting to gain unauthorized access.
• Use automated systems (bots, scrapers) to access the Services in a way that exceeds normal personal use.
• Use the Services to build a competing product or to train machine learning models, unless we agree in writing.

Your content

Some of our apps let you create, store, or share content ("Your Content"). You keep all rights to Your Content. Most of our apps store Your Content locally on your device or in your personal cloud account, and we do not access it.

Where the Services do require us to host or process Your Content (for example, to deliver a feature you have asked for), you grant us a limited, worldwide, royalty-free license to host, store, copy, transmit, and display Your Content solely as needed to operate and improve the Services. We do not use Your Content for advertising, and we do not use it to train AI models.

You are responsible for Your Content and for making sure you have the right to use it.

Purchases, subscriptions, and free trials

Paid features and subscriptions for our iOS apps are sold and managed by Apple through the App Store. Pricing, billing, free trials, renewals, and refunds are governed by Apple's terms and your App Store account settings. You can manage or cancel a subscription at any time in your device's Settings → Apple ID → Subscriptions.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. We are not able to issue refunds directly for App Store purchases — please contact Apple Support for refund requests.

Intellectual property

The Services, including all software, designs, graphics, text, and other content (other than Your Content), are owned by Mojave Labs or our licensors and are protected by copyright, trademark, and other laws. We reserve all rights not expressly granted in these Terms. "Mojave Labs," our logo, and our product names are our trademarks; you may not use them without our written permission.

Feedback

If you send us ideas, suggestions, or feedback about the Services, you agree that we may use them for any purpose without obligation to you. We appreciate hearing from you.

Third-party services

The Services may interoperate with or contain links to third-party services (for example, Apple's iCloud, App Store, or Sign in with Apple). We are not responsible for those third-party services, and your use of them is governed by their own terms and privacy policies.

Beta and pre-release features

We may offer features or apps marked as "beta," "preview," or similar. These are provided "as is," may be unstable, and may be changed or discontinued at any time. Use them at your own risk.

Changes to the Services

We are constantly improving the Services. We may add, change, or remove features from time to time. We will try to give reasonable notice of significant changes, but we are not required to maintain any particular feature.

Suspension and termination

You can stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or if we reasonably believe your use poses a risk or liability to us or other users. Sections of these Terms that by their nature should survive termination will survive (for example, intellectual property, disclaimers, limitation of liability, and dispute resolution).

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mojave Labs and our officers, employees, and contractors from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

Apple-specific terms

For apps you obtain through Apple's App Store, the following also apply:

• These Terms are between you and Mojave Labs only, not with Apple. Apple is not responsible for the apps or their content.
• Your license to use an app is limited to use on Apple-branded devices that you own or control, in accordance with the Usage Rules in Apple's Media Services Terms.
• Apple has no obligation to provide maintenance or support for the apps.
• If an app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims, losses, or damages will be our responsibility, not Apple's.
• Apple is not responsible for addressing claims related to the apps, including product liability, legal compliance, or intellectual property claims.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law and disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Illinois will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Services, except that either party may seek injunctive relief in any court of competent jurisdiction. If you live in a country whose laws give you the right to bring claims in your local courts, nothing in these Terms limits that right.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, give you additional notice. Your continued use of the Services after a change becomes effective means you accept the updated Terms.

Miscellaneous

These Terms are the entire agreement between you and Mojave Labs about the Services. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition, or sale of assets.
